Business
Responsible for negotiation of business transactions and preparation of documents and agreements related to business, corporate, and real estate matters, including international transactions.
Labor and Employment
The JHHS Employment and Labor Affairs Practice Group represent clients before various local, state, and federal regulatory agencies regarding administrative charges or complaints filed by employees. The Group develops and provides training to human resources staff, management and executives regarding compliance with all employment, labor and business laws, including but not limited to the Family Medical Leave Act, Fair Labor Standards Act, Americans with Disability Act, Title VII of the Civil Rights Act, as well as other laws impacting corporate employers. The Group also drafts and negotiates severance, settlement, non-compete, non-disclosure, non-solicitation, and various other employment related agreements. In addition, they provide legal opinions and guidance to ensure clients understand obligations they must meet to comply with labor and employment-related laws and regulations. This Group also oversees employment-related litigation.
Technology and Commercial Transactions
The JHHS Technology and Commercial Transactions Practice Group provides legal support to JHHS and its affiliates regarding a variety of complex transactions and programs. These include IT, software, content and intellectual property licensing, software-as-a-service/cloud-based applications, IT-related support and maintenance services, trademarks and branding, artificial intelligence, telecommunications, marketing and media agreements, strategic collaborations, and other general commercial agreements. The Group works closely with The Privacy Office and IT@JH on data use and security issues, including data sharing activities with healthcare related organizations and third-party studies. The Group also researches and interprets federal and state laws and regulations in technology and transactional areas, fraud and abuse (Anti-Kickback Statute), vendor rebates, and website accessibility, among other matters. The Group counsels clients on rights and protections of JHM-created intellectual property and provides legal support to JHHS Supply Chain, Marketing, JHHP, and a variety of other clients within the system.
Clinical Affairs, Patient Care and Medical Staff
The JHHS Risk Management Group provides 24/7 legal and risk management advice to all JHM entities, specifically related to patient safety events, regulatory and patient complaints, bioethical issues, guardianships and medical staff matters. In addition, this group provide legal and risk management education for faculty and staff, policy review and revision for legal and risk management implications, medical staff bylaws review and revisions and consultation with leadership on hospital and system clinical and medical staff issues.
Claims and Litigation
Responsible for advice on matters related to Johns Hopkins Medicine professional liability and general liability claims and risk management issues.
HIPAA
The Johns Hopkins Privacy Office provides general guidance, advice and assistance with regard to the privacy of health information obtained, retained and used by Johns Hopkins health care provider entities (hospitals, physician offices, clinics, etc.) and Johns Hopkins health plans, with primary focus on compliance with privacy law requirements including HIPAA and its related regulations; the substance abuse regulations; the Maryland medical records statute; state breach notification laws; and various other statutes and regulations. The Privacy Office is staffed with a variety of professionals who perform an array of functions, including providing legal advice, fulfilling the regulatory requirement of a “Privacy Officer” as well as performing required regulatory obligations such as training and monitoring of compliance.
Managed Care and Population Health
The JHHS Managed Care Practice Group supports general payor relations and contracting strategy for the Office of Managed Care and general provider relations and contracting strategy for the JHHP Provider Relations Department. The group provides executive support to the Johns Hopkins Health Plan payor business and operational functions. The Group also supports JHM Population Health initiatives and the Johns Hopkins Clinical Alliance.
Florida Enterprise and Antitrust
Responsible for providing advice and counsel on Johns Hopkins Health System’s operations in the state of Florida, including business transactions and contracts, employed physician enterprise, clinical collaborations and strategic planning, and state and local legislation and regulation.
Research and Graduate Medical Education Compliance
In cooperation with The Johns Hopkins University General Counsel’s Office, several attorneys within the office provide advice with respect to research and graduate medical education compliance, including IRB matters and graduate medical education procedures, as these issues pertain to the Health System.
